These Terms & Conditions (“Terms”) govern your access to and use of West Marin Jobs Hub (the “Platform”), operated by West Marin Fund (“we,” “us,” or “our”). By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform. 

1) User Eligibility & Accounts

  • You must be 16 years or older to use the Platform. The Platform is not intended for children under 16.
  • You agree to provide accurate information and to maintain the confidentiality of your login credentials. 
  • You are responsible for all activity under your account. Notify us immediately of unauthorized use.

2) Employer Responsibilities

Employers agree to: 

  • Post accurate, truthful, and current job listings.
  • Ensure postings comply with applicable employment and labor laws, including antidiscrimination laws at the federal, state, and local levels. 
  • Not post content that is false, deceptive, discriminatory, harassing, or illegal; or that requests impermissible information (e.g., protectedclass details). 
  • Use applicant information solely for legitimate hiring purposes and maintain the confidentiality of applicant data. 
  • Remove or update filled or expired positions promptly.

We may remove postings or suspend accounts for violations. 

3) Job Seeker Responsibilities

Job seekers agree to: 

  • Provide accurate résumés, profiles, and application materials (no misrepresentation of credentials or employment history).
  • Apply only to legitimate job listings and communicate professionally. 
  • Respect employers’ confidentiality and data handling requirements. 

4) User Content; License to Us

  • You retain ownership of content you submit (e.g., job listings, résumés, profiles, messages). 
  • You grant us a nonexclusive, worldwide, royaltyfree license to host, store, reproduce, modify (for formatting/display), and display your content solely to operate and improve the Platform
  • You represent you have the rights to submit the content and that it does not infringe others’ rights. 

5) Platform Functionality

  • We may modify, suspend, or discontinue any feature without notice. 
  • We do not guarantee any hiring outcomes or candidate/employer actions. 

6) AntiDiscrimination & EEO Compliance (Job Board Requirement)

All postings must comply with applicable Equal Employment Opportunity laws and antidiscrimination rules (e.g., no discrimination based on race, color, religion, sex, national origin, age, disability, genetic information, or other protected characteristics under federal, state, or local law). We may remove postings or suspend accounts that violate this policy. 

7) ThirdParty Links & Services 

The Platform may include links to thirdparty sites or services. We are not responsible for their content, policies, or practices. 

8) Suspension & Termination 

We may suspend or terminate access to the Platform (including removal of content) at our discretion for violations of these Terms, security risks, unlawful activity, or to comply with law. You may stop using the Platform or request account deletion at any time. 

9) No Fees; No Payment Processing 

We do not currently sell products or services through the Platform. If this changes, we will update these Terms and our Privacy Policy. 

10) Prohibited Conduct 

You may not:

  • Post unlawful, misleading, or discriminatory content. 
  • Harass, threaten, or defraud others. 
  • Attempt to disrupt, overload, or reverseengineer the Platform. 
  • Use automated scraping, bots, or similar tools without our written permission. 
  • Misuse personal information obtained through the Platform. 

11) DMCA Notice (Copyright) 

If you believe content on the Platform infringes your copyright, send a DMCA notice including: 
(a) your physical/electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing content (URL); (d) your contact information; (e) a statement of goodfaith belief; and (f) a statement under penalty of perjury that the information is accurate and you are authorized to act. 
Send to: info@westmarinjobshub.org (Subject: “DMCA Notice”). We may remove or disable access to the content and may terminate repeat infringers. If you believe content was removed in error, you may submit a counternotice as permitted by law. 

12) Disclaimers; Limitation of Liability 

The Platform is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied. 
We are not responsible for: (i) accuracy or legality of postings; (ii) actions or decisions of employers or job seekers; (iii) employment outcomes; (iv) interruptions or errors; or (v) loss of data or profits. 
To the fullest extent permitted by law, our total liability for any claim arising from or relating to the Platform shall not exceed $100

13) Indemnification

You agree to indemnify and hold harmless West Marin Fund and its officers, directors, employees, and volunteers from claims arising out of your use of the Platform, your content, or your violation of these Terms or applicable law. 

14) Dispute Resolution; Governing Law; Class Waiver 

  • Goodfaith negotiation (30 days): Before filing a claim, you agree to email us at info@westmarinjobshub.org to try to resolve the issue informally within 30 days. 
  • Arbitration: If not resolved, disputes will be resolved by binding arbitration on an individual basis under the Federal Arbitration Act and the rules of JAMS or AAA (your choice), conducted in Marin County, California (or by video upon mutual agreement). 
  • Class action waiver: No class actions or consolidated proceedings. 
  • Small claims option: Either party may bring a claim in small claims court in Marin County, CA. 
  • 30day optout: You may opt out of arbitration within 30 days of first accepting these Terms by emailing info@westmarinjobshub.org with subject “Arbitration OptOut” and your account email. 
  • Governing law: California law (without regard to conflict of laws), except that the FAA governs arbitration. 

15) Changes to the Terms 

We may update these Terms from time to time. The “Last updated” date reflects the effective date. Continued use after changes constitutes acceptance.

This Privacy Policy explains how West Marin Fund (“we,” “us,” “our”) collects, uses, shares, and protects personal information when you use West Marin Jobs Hub (the “Platform”). 

By using the Platform, you consent to the practices described in this Policy. 

1) Who We Are

2) Information We Collect 

Information you provide: 

  • Name, email address, account credentials 
  • Employer organization details and job posting content 
  • Support inquiries and feedback 

Information collected automatically: 

  • IP address, device and browser data, operating system 
  • Usage data (pages viewed, referring/exit pages, timestamps, feature use) 
  • Approximate location (IPbased) 
  • Cookies and similar technologies (see §10 Cookie Policy) 

Sensitive data: We do not seek to collect sensitive personal information. Please do not include protectedclass or sensitive information in or postings unless legally required and clearly disclosed. 

3) How We Use Information 

  • Operate, maintain, and improve the Platform 
  • Enable employers to post jobs 
  • Allow career counselors to share job postings with clients 
  • Authenticate and secure accounts; prevent fraud and abuse 
  • Communicate about accounts, updates, and service notices 
  • Provide support and respond to inquiries 
  • Analyze usage and performance (analytics) 
  • Comply with legal obligations 

If we send promotional or newsletter emails, you can unsubscribe at any time (see §6). 

4) How We Share Information 

We share personal information:

  • With service providers (e.g., hosting, analytics, email delivery, customer support). 
  • For legal reasons (to comply with law, enforce terms, protect rights/safety). 
    We do not sell personal information. We do not currently use payment processors (no sales on the Platform). 

5) Data Retention 

  • Account data: kept while your account is active; deleted or anonymized within 90 days of verified deletion request, subject to legal holds. 
  • Job postings & applications: retained while the posting is active and for a reasonable period thereafter for audit/security (typically 12–24 months), unless you delete or request deletion earlier. 
  • Logs/analytics: typically 12–24 months in aggregated or pseudonymized form. 
    We may retain minimal records as required by law or for security/fraud prevention. 

6) Emails; CANSPAM 

We may send:

  • Transactional emails (account, security, application updates). 
  • Informational/marketing emails (optional). You may unsubscribe via the link in any email or by contacting us at info@westmarinjobshub.org

7) Your Rights 

Depending on your location, you may have rights to: 

  • Access your data; correct inaccuracies; delete data 
  • Withdraw consent where processing is based on consent 
  • Receive a copy of certain information (portability) 
  • Object or restrict certain processing (where applicable) 

Submit requests to info@westmarinjobshub.org. We may need to verify your identity before fulfilling requests. 

8) California Privacy (CCPA/CPRA) 

If you are a California resident, you may have the right to: 

  • Know the categories of personal information collected, purposes, and categories of disclosures; 
  • Access and delete personal information (subject to exceptions); 
  • Correct inaccurate personal information; 
  • Optout of “sale” or “sharing” for crosscontext behavioral advertising (we do not sell or share for these purposes); 
  • Limit the use of sensitive personal information (we do not use SPI for inferring characteristics).

8.5) Other U.S. State Rights

Residents of states with comprehensive privacy laws (e.g., CO, CT, VA, UT and others as enacted) may have similar rights to access, correct, delete, and optout of targeted advertising/profiling. Contact info@westmarinjobshub.org to exercise these rights. 

9) GDPR (EU/UK) Disclosures 

If GDPR applies to you, our legal bases for processing may include:

  • Contract (providing the Platform and facilitating applications) 
  • Legitimate interests (security, analytics, service improvement) 
  • Consent (nonessential cookies; certain communications) 
  • Legal obligation (compliance, recordkeeping)

You may have the rights listed in §7 and the right to lodge a complaint with your local supervisory authority. For crossborder transfers to the U.S., we rely on appropriate safeguards (e.g., SCCs or other recognized mechanisms, as applicable). Contact info@westmarinjobshub.org for details. 

10) Cookie Policy (Integrated) 

What we use and why: 

  • Strictly necessary cookies: signin, session management, security. 
  • Performance/analytics cookies: to understand site usage and improve features (e.g., Google Analytics). 
  • Functional cookies: remember preferences (e.g., language). 
  • Advertising cookiesNot used at this time. If introduced, we will update this Policy and provide controls. 

Thirdparty cookies: 

  • Google Analytics may set cookies to measure traffic and usage patterns. You can opt out via:  
  • Browser settings to block/clear cookies, 
  • Google Analytics Optout Browser Addon, and 
  • The cookie banner/preferences (where available). 

Your choices: 

  • Manage cookies in your browser settings; 
  • Use our inproduct cookie controls (if available); 
  • Opt out of Google Analytics via the official addon. 

Do Not Track: We currently do not respond to DNT signals. 

11) Security

We use reasonable administrative, technical, and physical safeguards (e.g., access controls, encryption in transit, secure hosting). No system is 100% secure. 

12) Children’s Privacy (COPPA)

The Platform is not intended for children under 16 and we do not knowingly collect their information. If you believe a child under 16 has provided information, contact info@westmarinjobshub.org and we will delete it. 

13) International Transfers

Your information may be processed in the United States. By using the Platform, you understand your information may be transferred and processed in countries with different data protection laws. 

14) Changes to This Policy

We may update this Policy periodically. The “Last updated” date reflects the effective date. Continued use of the Platform after changes constitutes acceptance.
